The services actually included in your purchase or subscription will be those specifically identified on the applicable order page, proposal, invoice, subscription plan, service description, or other written agreement.
The inclusion of a service category in these Terms does not mean that the service is included in every Kylvanta subscription.
Kylvanta may introduce new services, products, features, plans, packages, or technologies in the future. Such services may be governed by these Terms, additional terms, or both.
2. Future Products and Services
Kylvanta may expand its business and offer additional products and services in the future.
New products or services may include services that do not currently exist or are not currently offered by Kylvanta.
Where appropriate, Kylvanta may provide additional terms, service descriptions, order forms, proposals, or agreements for those products or services.

The specific price, scope, deliverables, subscription structure, limitations, and requirements for a future product or service will be disclosed to the customer before purchase where required by applicable law.

An order or checkout page;
A subscription plan;
A proposal;
An invoice;
A statement of work;
A service description;
A written agreement;
Additional product-specific terms; or
Other terms expressly incorporated into the customer's purchase.
The applicable documents together form the agreement between Kylvanta and the customer.
If a specific written agreement or service-specific term conflicts with these Terms, the specific agreement will govern to the extent of the conflict.
WEBSITE + SEO SUBSCRIPTION
4. Current Website + SEO Subscription
Kylvanta currently offers website and SEO services through a month-to-month subscription.
The subscription may include:
Website design and development;
Website-related services;
Website updates;
Website content implementation;
Search engine optimization;
On-page SEO;
Technical SEO;
Keyword optimization; and
Other services expressly included in the customer's subscription.
The exact services included in the customer's subscription will be identified at the time of purchase.
Services not expressly included may be purchased separately.
5. Month-to-Month Subscription
Unless otherwise stated in writing, Kylvanta website and SEO subscriptions operate on a month-to-month basis.
There is no minimum subscription term unless a separate written agreement states otherwise.
The subscription automatically renews each month until cancelled or terminated in accordance with these Terms.
6. Setup Fee
A one-time $100 CAD setup fee applies to the initial setup of the website and services unless otherwise stated in writing.
The setup fee is separate from the recurring monthly subscription.
The setup fee covers initial onboarding, configuration, preparation, and setup work.
Once Kylvanta has begun performing setup or onboarding work, the setup fee is generally non-refundable, except where otherwise required by applicable law or agreed to by Kylvanta.
7. Subscription Fees
The customer agrees to pay the subscription price displayed at the time of purchase or otherwise agreed to in writing.
Unless otherwise stated, prices are in Canadian dollars.
Applicable taxes, including GST/HST where required, may be added.
Kylvanta may introduce different pricing, packages, plans, or service levels in the future.
A customer's existing subscription price will not be changed without appropriate notice where required by applicable law.
8. Automatic Renewal and Recurring Payments
By subscribing to a recurring Kylvanta service, the customer authorizes Kylvanta or its payment processor to charge the applicable recurring subscription fee.
The subscription will renew monthly unless cancelled.
The customer is responsible for maintaining accurate payment information.
If a payment fails, Kylvanta may attempt to process the payment again and may contact the customer regarding the outstanding amount.
9. Cancellation by the Customer
The customer may cancel a month-to-month subscription using the cancellation method provided by Kylvanta.
Unless otherwise required by applicable law, cancellation will normally take effect at the end of the customer's current paid billing period.
The customer generally remains responsible for the applicable subscription fee for the current billing period.
Cancelling a subscription does not automatically entitle the customer to a refund for a period that has already begun.
Nothing in these Terms limits any cancellation or refund rights that cannot legally be excluded under applicable law.
10. Suspension or Termination
Kylvanta may suspend or terminate services where:
Payment remains overdue;
The customer materially breaches these Terms;
The customer uses the service unlawfully;
The customer provides fraudulent or harmful information;
The customer abuses Kylvanta's systems;
The customer infringes third-party rights;
The customer's conduct creates a legal or security risk; or
Continuing the service is otherwise reasonably impractical or prohibited.
Where reasonably possible, Kylvanta will provide notice and an opportunity to correct the issue.
11. Website After Cancellation
Customer-Owned Domain
If the customer already owns their domain, the customer remains the owner of that domain.
When the Kylvanta subscription ends, Kylvanta may disconnect, remove, or disable the Kylvanta website from that domain.
Kylvanta does not take ownership of a domain merely because the Kylvanta website was connected to it.
Domain Provided by Kylvanta
If Kylvanta arranged or provided a domain as part of the service, the website may be taken offline when the subscription ends.
Domain registration may be subject to the terms and policies of the applicable domain registrar.
Kylvanta does not guarantee that a domain will remain available after cancellation.
12. Website Ownership
Unless expressly agreed otherwise in writing, the customer's subscription provides access to a Kylvanta website service rather than transferring ownership of Kylvanta's underlying website systems.
Kylvanta retains ownership of its:
Templates;
Frameworks;
Reusable code;
Components;
Systems;
Design systems;
Processes;
Automations;
SEO systems;
Proprietary tools;

The customer receives a limited right to use the website while the subscription remains active and paid.
This right ends when the subscription ends unless otherwise agreed in writing.

The customer remains responsible for legitimate amounts owed for services provided before termination.

Unless otherwise required by applicable law:
Monthly subscription fees generally cover the applicable service period and are not refundable once services for that period have been provided;
Cancelling a subscription does not automatically create a refund for a partially used billing period;
The $100 setup fee is generally non-refundable once setup work has begun; and
Additional products or services may have separate refund terms disclosed at the time of purchase.
Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be excluded.
